Data Controller - the "Titulaire" of the Correlative Obligations to the Right to Personal Data Protection

Summary/Abstract: The paper enshrines an analysis of the concept of "data controller", by looking into its legal definition and by creating a simple grid for the criteria to identify the controller of a given processing operation. At the same time, the paper reflects on the concepts of "co-controllers" and "processors", looking at how they are enshrined in the draft General Data Protection Regulation, as well as looking at how a Romanian Court applied the existing relevant legal framework.
