Summary/Abstract: Returning to a separate commercial law no longer belongs to the mainstream of todays codifi cation of private law, but the representation of a commercial law-like view of private law within the private law is an undisputed important requirement in the context of the national legal system and in the process of the codifi caion of the european private law, especially in areas such as company law, the law of securities – which is standing in very close connection with company law -, competition law, and further on bankruptcy law. The law material on business associations has mostly private law character, but of course some of it‘s provisions have the nature of public law and procedure law. It complies with company law, constitutional law, copyright, labor law, law of bankruptcy proceedings and liquidation proceedings, law of the capital market, and with the law of public accountancy. In this sense is corporate law as a synergy-phenomenom an element of the legal system.
